These terms govern your use of bluskyi.com and the BluSkyi platform (the “Service”), operated by BluSkyi Limited (“BluSkyi”, “we”, “us” or “our”), a company registered in England and Wales with its registered office at First Floor, 736 High Road, North Finchley, London N12 9QD, United Kingdom.
By creating an account or using the Service, you agree to these terms. If you do not agree, please do not use the Service. We recommend reading these terms alongside our Privacy Policy, which explains how we handle your personal data.
1. Who can use the Service
You must be at least 18 years old and able to enter into a binding contract to hold an account. By using the Service you confirm that you meet these requirements. The Service is intended for professional use.
If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms, and “you” includes that organisation.
2. Your account
To use most of the Service you need an account. You can register with an email address, or sign in using Google or LinkedIn. When you use a third-party sign-in option, that provider shares limited profile information with us so we can create or access your account, as described in our Privacy Policy.
You are responsible for keeping your login details secure and for all activity under your account. Accounts are personal to you and may not be shared, sold, or transferred. Please tell us promptly at hello@bluskyi.com if you believe your account has been accessed without your permission.
You agree to provide accurate information when you register and to keep it up to date.
3. The Service
BluSkyi is a personalised, curated research briefing service. We select published research relevant to your profession and the disciplines you choose, and our editorial team oversees its transformation into concise briefings. The Service also includes features that help you track continuing professional development (CPD).
We may add, change, or remove features over time as the Service develops. We currently focus on engineering and intend to extend the Service to other professional sectors.
4. Founding subscriber phase
During our founding subscriber phase, eligible engineering subscribers receive six months of free full access to the Service. No payment is taken during this period.
We will give you reasonable notice before the free period ends or before paid subscriptions are introduced, so you can decide whether to subscribe. You are under no obligation to take a paid plan, and we will not begin charging you without your agreement.
5. Subscriptions, pricing and payment
We offer individual, team, and enterprise plans. The plans available to you, and their prices, are shown at the point of subscription. Prices are stated in US dollars unless we indicate otherwise, and may exclude taxes that apply to you.
When paid subscriptions are available:
- Billing. You authorise us, through our payment processor, to charge your chosen payment method for the plan you select. We do not store full payment card numbers.
- Renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual, depending on your plan) at the then-current price, unless you cancel before the renewal date.
- Price changes. We may change our prices. If a change affects your renewal, we will give you reasonable notice beforehand so you can decide whether to continue.
6. Cancellation and refunds
You can cancel your subscription at any time from your account. When you cancel, your subscription continues until the end of the period you have already paid for, and you keep access until then. We do not provide refunds for partial billing periods.
If you are a consumer in the UK or EU, you have a legal right to cancel within 14 days of subscribing. Because the Service gives you immediate access to digital content, by subscribing and asking to start using the Service straight away you agree that we may begin providing it within that period, and you acknowledge that you lose the 14-day cancellation right once access has begun. This does not affect your other statutory rights.
7. Acceptable use
You agree to use the Service lawfully and only for its intended purpose. You must not:
- copy, redistribute, resell, publish, or otherwise make the briefings or other content available to anyone outside your account;
- use automated means to scrape, harvest, or extract content or data from the Service;
- attempt to access, interfere with, or disrupt the Service, its security, or its infrastructure;
- reverse engineer, decompile, or attempt to derive the source code or underlying methods of the Service, except to the extent the law does not allow this to be restricted;
- use the Service to build or train a competing product or to develop a competing dataset; or
- use the Service in any way that infringes the rights of others or breaches any applicable law.
We may suspend or restrict access if we reasonably believe these terms are being breached.
8. Intellectual property
The Service, including its design, software, editorial briefings, summaries, compilations, structure, and the BluSkyi name and logo, is owned by us or our licensors and is protected by intellectual property laws.
While your account is active and in good standing, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use the Service and its content for your own professional purposes. This licence does not allow you to redistribute or commercially exploit the content, and all rights not expressly granted are reserved.
The underlying research articles, pre-prints, and source materials that our briefings are based on remain the property of their respective authors, publishers, and rights holders. Our briefings are our own summaries and do not transfer any rights in the original works to you.
9. Research content and professional judgement
Our briefings are concise editorial summaries of published research. They are provided for information and professional awareness only.
Briefings are not engineering, technical, legal, financial, or other professional advice, and you should not rely on them as a substitute for the primary sources or for your own professional judgement. Research evolves, summaries necessarily omit detail, and errors can occur. Before acting on anything you read, you should consult the original source and apply your own expertise. We are not responsible for decisions you take based on the briefings.
10. CPD features
Our CPD features help you record and track professional development activity. You are responsible for ensuring that the activities you log and the records you generate meet the requirements of your professional body. We do not guarantee that any record will be accepted by a professional body, and we are not responsible for the consequences if it is not.
11. Third-party services and content
The Service relies on third parties, including our hosting provider and the Google and LinkedIn sign-in options, and it draws on research published by third parties. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.
12. Availability and changes to the Service
We aim to keep the Service available and working well, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance, and we may modify or discontinue parts of the Service. Where a change materially reduces what you have paid for, we will act reasonably and fairly in addressing it.
13. Suspension and termination
You may stop using the Service and close your account at any time.
We may suspend or terminate your access if you materially breach these terms, if we are required to by law, or if continuing to provide the Service to you would expose us to liability or harm. Where it is reasonable to do so, we will give you notice and an opportunity to put things right first.
When your account ends, your right to use the Service stops. Sections that by their nature should survive termination, including those on intellectual property, disclaimers, and liability, will continue to apply.
14. Disclaimers
The Service is provided on an “as available” basis. To the fullest extent permitted by law, we exclude all warranties, conditions, and representations not expressly set out in these terms, including any implied warranties of satisfactory quality or fitness for a particular purpose.
Nothing in these terms excludes or limits any rights you have as a consumer that cannot be excluded or limited by law.
15. Limitation of liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited by law.
Subject to that, and to the fullest extent permitted by law:
- we are not liable for loss of profits, loss of business, loss of data, or any indirect or consequential loss; and
- our total liability to you in connection with the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or £100.
If you use the Service as a consumer, we are responsible for loss that is a foreseeable result of our breach, but not for anything outside our reasonable control.
16. Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. If you continue to use the Service after a change takes effect, you accept the updated terms.
17. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction over any dispute, although if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
18. General
These terms are the entire agreement between you and us regarding the Service. If any provision is found to be unenforceable, the rest will continue to apply. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a sale or reorganisation of our business, without reducing your rights.
